Disobedient officer wins court case
Major said order could support war

24. Juni 2005 F.A.Z. Weekly. The German Administrative Court on Wednesday overturned a demotion handed to a German military officer who disobeyed an order that he maintained could be related to the war in Iraq.
In supporting the officer, the court said that professional soldiers also were entitled to freedom of conscience.
The case goes back to a decision that the major made in April 2003 when the United States was waging its war against Iraq in a push to overthrow the dictator Saddam Hussein. The major refused to continue working on a software program that he maintained could be used to support the war in Iraq. He also argued that none of his superiors could guarantee that his work would not be used to provide logistical support to the United States, an ally of Germany in the North Atlantic Treaty Organization. He said any support of the war amounted to a breach of the German constitution and human rights.
The military charged him and wanted to dismiss him from service. A military court convicted the major in February 2004 of refusing to obey an order and demoted him to captain, which meant a reduction in pay.
The officer then appealed to the Federal Administrative Court, located in the eastern city of Leipzig. The appeals court ruled that an order could not take precedence over the officer's conscience. It said the German military, as a part of the national government, ”was tied without limitation to justice and the legal code, including basic rights.”
